Villa Yiamas, Peyia, Cyprus – Holiday Rental Terms and Conditions

 

As Owners, these are our standard terms and conditions for the holiday rental of Villa Yiamas (‘the Property’) to the person named on the invoice (‘the Guest’). The Guest must be over 21 and is responsible for informing all members of the party about these Terms and for ensuring that they are followed. In contracting a holiday rental the Guest expressly acknowledges their acceptance of these Terms and Conditions.

Bookings

We will provide a written quotation by e-mail showing the rental fee for the property inclusive of all standard advertised facilities (with the exception of air-conditioning – see below). Quotations are valid for 7 days.

Where the Guest agrees by e-mail or other written device to book the property, we will send a provisional booking advice to the Guest by e-mail. This advice will explain how a non refundable deposit payment amounting to 25% of the total due should be made and request further details about the Guest and their party. This information will be kept confidential by the Owners and will only be used in connection with the holiday booking and related services. We will not sell or pass on your details to any third party.

Until such time as the Guest has paid the requested deposit or payment as defined on the provisional booking confirmation, the booking will be considered provisional.

Payments and Contract

To confirm a booking, the Guest should send the non-refundable deposit in Sterling or Euros to the bank account stipulated by the Owners within 3 days of receiving the provisional booking advice. Following clearance of the deposit funds, we will issue a rental invoice by e-mail or postal mail to the Guest at which time the Owners and Guest will enter a binding contract.

This rental invoice will show the 25% deposit as paid and the balance due, together with the due date for the balance payment, which will be 60 days prior to the date of arrival at the villa. It is the responsibility of the guest to ensure that the balance payment is made in time. If the booking is made within 60 days of the holiday rental the full amount will be due immediately.  Directions to find and access the Villa will be provided after the Owners receive payment in full.

A security deposit of £200 (€240) will also be due at the time of the balance payment. This will be itemised separately on the invoice and will be returned to the guest within three weeks of departure, subject to any damage or losses assessed by the Villa Managers after the Guest has departed. Delays may arise if professional quotations for repairs are required. In the event that the damage is assessed to be in excess of the security deposit, the Owners reserve the right to recover the additional costs from the Guest.

A charge of €20 will be deducted from the security deposit if the BBQ has to be cleaned by the management company.  Please leave the BBQ clean to avoid this charge.

The Guest agrees to pay the full invoice value within the due dates set out in the invoice. If it is not paid on time we reserve the right to cancel the booking and retain the deposit.

Cancellation

You may cancel your booking at any time but no refund will be made for any monies paid.  We regret that this applies whatever the circumstances may be and whatever other costs may be incurred by the Guest as a result of them having to cancel (such as flight and car hire charges).  Wholly unforeseen events may result in you having to cancel, so we strongly advise that all members of the holiday party obtain appropriate travel and personal insurance cover.

If the Villa should become uninhabitable for any reason such as fire or flood prior to the holiday rental and the Owners need to cancel a Guest booking, they will return all monies paid. In these circumstances the Guest will have no further claim against the Owners, who will not be liable for personal expenses the Guest may have incurred as a result of their booking, such as travel tickets, travel insurance, etc.

Facilities Included in Rental

The Villa is offered for short-term rental on a self-catering basis with all the equipment and facilities advertised in the Villa Website. Reasonable effort is made to ensure that our website is accurate and the Owner shall not be liable for any inaccuracies or omissions.

A Complimentary welcome pack comprising bread, margarine, jam, tea, coffee, milk, sugar, and fruit juice will be available to the Guest upon arrival.  In addition, a supply of toilet rolls, soap, washing up liquid, dishwasher tablets, insecticidal spray, waste bags, cling film and related kitchen supplies will be on hand but the Owners request that the Guest replenishes such supplies during their holiday and before their departure.

Local maps and guide-books together with a library of books, DVDs, videos and some table-games will also be available for Guest use but the Owners request that these items be left in the Villa when the Guest departs.  If you wish to add to our libraries by leaving your own purchases this will be appreciated by future guests.

All water, electric, pool maintenance and garden maintenance is included in the rental charge. However, due to the extra expense of air-conditioning, a daily charge will be levied on the day after arrival by the local Managers. This charge will be €4.50 per unit per day for however many units the guest may elect to use. There is one unit in each bedroom and 2 units in the open-plan living/dining/kitchen area. All units not required will be locked off at this time.  A maximum of four units can be used at any one time because of power restrictions.

Whilst the Property is equipped with internet access the Owner cannot be held liable for any malfunctions or technical problems with Internet Service Providers nor for the operating speed available.  The TV system provided is internet based and cannot be guaranteed to work constantly.

The Owner cannot be held responsible for the failure of public utilities such as water and electricity.

Guest Responsibilities

The Guest is responsible for the Villa during their stay and is expected to take reasonable care of it and to leave it in a clean and tidy condition.  The Owners have furnished the Property to a high standard and the Guest should take due care and attention. Any costs of damage, losses or extra cleaning are the responsibility of the Guest and will be deducted from the security deposit.  No smoking is allowed in the Property and pets cannot be accommodated.

The Property should be left clean and tidy at the time of checkout and all personal waste should be removed from the property.  Any damage or breakages to the Property caused by the Guest must be reported to the Villa Managers immediately and appropriate compensation made if greater than the security deposit. Guests should not move any furniture or equipment without prior written consent from the Owner or the Property manager. In the event of such permission being granted, it is the customer’s responsibility to return the same to its original position before checkout. Under no circumstances must any property found inside the property be moved outside.  Guests must not sit on any indoor furniture when wearing wet clothes or bathing suits.

Any valuables left at the property are left at the Guests’ own risk. The Owner is not responsible for any loss. The safe should be used and proper care be taken against theft and burglary. It is the Guests’ responsibility to ensure all doors and windows are closed and locked when leaving the property or whenever they are in the outside areas of the Property. If theft or damage to the property occurs through negligence on the part of the Guest, the Owner will be entitled to seek compensation from the Guest.

Arrival at the villa is after 3 pm; departure is by 11 am, to allow for preparation for the changeover of guests.

Guest Behaviour

The Guest is responsible for the correct and decent behaviour of all members of the party. Should you or a member of the party not behave in such a manner, the Owner or their manager may use their absolute discretion to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation. The Owner will not have any further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and the Owner will not pay any expenses or costs incurred as a result of the termination.

Only the persons stated on the completed Booking Form may use the property unless otherwise agreed in advance by the Owner. The maximum number of six people, including infants, may not be exceeded unless agreed with the Owner in writing in advance. The Owner has the right to terminate hire without prior notice and without refund or compensation if the number is exceeded.

The Property may not be used for any function (e.g. party, wedding, cocktail party).  The Property is in a residential area and neighbours must be considered at all times.

Managing Agent

In the event that the Guest has a problem whilst in the property, he or she should contact our managing agent, Apollo Management, on mobiles 99185073 or 99940127. The Owners will not be liable for the consequences of any faults or shortcomings in the rental property which are not reported promptly to the Managing Agent.

The Owners or their Agents shall be allowed access to inspect the property prior to the Guest departure. They also have the right to access the property if urgent maintenance is required.

Garden and pool maintenance staff may enter the grounds of the property during your stay, normally early in the mornings and they should not be denied access.

Liability

The Owners cannot be held liable to accept responsibility for death, accident, bodily injury, loss of goods or illness whilst in the accommodation.

Guests should take common sense precautions against accident and personal injury during their holiday rental. Guests are also warned to take special care in and around the pool area, not to dive into the pool at anytime and to supervise children at all times. In addition, Guests should take special care when using the BBQ equipment – it will get very hot in use and it will burn on contact.

Occasionally, due to extensive use of the pool, water in the ears may cause an ear infection, especially with children. This does not necessarily mean the pool does not have the correct level of chlorine but it should be reported to the Managing Agent or Pool Attendant so that it can be checked. Please dry your ears thoroughly after you leave the pool to ensure you remove any trapped water that may become infected.

The Owner does not accept liability for acts of violence, nature, fire, flood, war, civil disobedience, riot or other force majeure that may have a deleterious effect on any Guest, whenever such acts may occur.

The Owner cannot be held responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond the Owner’s control.

Jurisdiction

This contract is governed by the law of England and Wales and the jurisdiction of the English and Welsh Courts.  No one has the authority orally to vary these terms and conditions or enter into any verbal agreements with the Guest.
